Safety Notice for Augmented Reality Game Use
Stay Safe While Playing: Always follow the safety guidelines provided by your Augmented Reality (AR) hardware manufacturer when using our Game Software. Make sure you've read and understood these guidelines thoroughly.
Be Mindful of Your Environment: Remember, while engaging with our AR games, your real-world surroundings might be out of sight. This could lead to accidental bumps or trips, so be aware of your space, move cautiously, and keep areas clear of obstacles, people, and pets.
Play Responsibly: Our games are immersive and might tempt you to move in ways that could be risky. Always stay in control of your actions and avoid rapid or unsafe movements. Use the hand controllers carefully, making sure there's enough space around you.
Use Supervision: It's a good idea to have someone nearby when you play, especially if you're a minor or if this is your first time using AR games. This person can help you stay aware of your environment and ensure you're playing safely.
Understanding the Risks: Using AR games can be physically demanding and may cause discomfort or even health risks for some people. If you feel overwhelmed, take off your headset and take a break. This software isn't recommended for children under 14, and those under 18 should have adult supervision.
Acknowledgment and Assumption of Risk
You hereby acknowledge and agree that your use of the Game Software is entirely voluntary and at your own risk. You are fully aware of the potential risks associated with the use of the Game Software, which include, but are not limited to, the risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. You understand that these injuries or outcomes may arise from your own actions or inactions, as well as those of others, during the use of the Game Software. You voluntarily choose to assume all known and unknown risks associated with the use of the Game Software, accepting full responsibility for any and all consequences that may arise as a result.
License
Limited Use License Agreement
This section defines the scope of your rights regarding the use of our Game Software. The term "Game Software" encompasses not only the software of the video game itself but also any related media, software for online modes (which may be subject to additional terms), as well as all printed materials, manuals, and online or electronic documentation. Additionally, it includes any copies of these elements.
Crafting Table Ltd. hereby provides you with a non-exclusive, non-transferable, and limited license. This license allows you to install and use a single copy of the Game Software on one device’s hard drive at any time, and this use is restricted solely for your personal, non-commercial purposes.
It's important to note that all rights not explicitly granted to you through this License remain reserved by Crafting Table Ltd. and its licensors. The provision of this License to you does not equate to the sale of the Game Software; rather, it's a grant of usage rights. Consequently, this License does not confer to you any title, ownership, or intellectual property rights in the Game Software, nor should it be interpreted as a sale or transfer of any rights associated with the Game Software.
Ownership Clause
By using our Game Software, you acknowledge and agree that Crafting Table Ltd., or its licensors, hold all rights to ownership and intellectual property in connection with the Game Software. This includes all aspects and copies of the software, whether in its current form or as any future derivative works. Specifically, this encompasses the titles, computer code, themes, objects, characters and their names, storylines, dialogues, catchphrases, settings, creative concepts, artwork, graphics, animations, soundtracks, musical compositions, audio-visual effects, text, the layout of screen displays, operational methods, moral rights, and any "applets" included within the Game Software, along with all associated documentation.
The Game Software is protected under the copyright laws of the United States, as well as international copyright treaties and conventions, United States and common law trademark laws, and other relevant legal frameworks. We reserve all such rights on a global scale. It's important to note that the Game Software may include certain materials that Crafting Table Ltd. has licensed from third parties. In the event of any breach of this Agreement, Crafting Table Ltd. and its licensors reserve the right to enforce their ownership and intellectual property rights pertaining to the Game Software.
License Conditions and Restrictions
In using our Game Software, you agree to comply with the following conditions and restrictions, ensuring your usage aligns with the terms of this License. You are not permitted to:
(a) Use, advertise, or commercially exploit the Game Software or any of its components without explicit written permission from Crafting Table Ltd. This includes, but is not limited to, commercial use in cyber cafes, computer gaming centers, or any other location-based sites. If you are a content creator you are allowed to monetize screen recordings of Game Software’s game play.
(b) Operate the Game Software on more than one computer simultaneously, unless granted a separate, additional license by Crafting Table Ltd.
(c) Engage the Game Software in networked, multi-user, or remote access setups, including online use, unless specifically authorized in writing by Crafting Table Ltd.
(d) Create copies of the Game Software or any part thereof, with the exception of one (1) copy for backup or archival purposes, or copies of accompanying materials for non-commercial backup and reference.
(e) Sell, rent, lease, license, distribute, upload, or transfer any portion of the Game Software or its copies without the express prior written consent of Crafting Table Ltd.
(f) Reverse engineer, derive source code, modify, decompile, disassemble, or create derivative works from the Game Software, either wholly or partially. Any lawful changes, as permitted by applicable law, will be deemed the property of Crafting Table Ltd. and/or its licensors, including all related intellectual property rights.
(g) Remove, disable, or bypass any security protections or technical measures that govern access to the Game Software.
(h) Alter, deface, or circumvent any proprietary notices or labels on or within the Game Software.
(i) Export or re-export the Game Software, or any copy or adaptation thereof, in violation of applicable laws or regulations.
(j) Create data or executable programs that duplicate the data or functionality found in the Game Software.
Additionally, you agree to adhere to any safety information, maintenance instructions, or other relevant notices included with or within the Game Software.
Game Software Updates and Patches
Crafting Table Ltd. reserves the right to release updates, patches, and other modifications for the Game Software. These updates are essential for maintaining the functionality, security, and overall performance of the game. In some cases, installing these updates may be necessary for you to continue playing the game effectively or at all.
Crafting Table Ltd. also has the capability to remotely update, patch, or modify the Game Software installed on your device. By accepting this Agreement, you grant Crafting Table Ltd. the express right to remotely deploy and apply these updates, patches, and modifications to the Game Software on your machine.
It is important to note that all references to the "Game Software" in this Agreement encompass the original version of the software and all subsequent patches, updates, and modifications provided by Crafting Table Ltd.
Limited Warranty
Acknowledgment of Risk
You acknowledge and agree that your use of the Game Software, and the media upon which it is recorded, is entirely at your own risk.
Warranty Disclaimer
Except as explicitly stated in this Agreement, the Game Software is provided "as is," without any form of warranty, either express or implied. This disclaimer includes, but is not limited to, any implied warranties of the software's condition, uninterrupted use, merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights. Please note that no advice or information, whether oral or written, obtained from Crafting Table Ltd. or through any of its authorized representatives, will create any warranty not expressly stated in this Agreement.
Limitation of Liability in Certain Jurisdictions
The laws of certain states and jurisdictions do not allow the exclusion or limitation of certain warranties. Therefore, in such states or jurisdictions, the liability of Crafting Table Ltd. and its licensors under this warranty shall be limited to the greatest extent permitted by law. This means that you might have additional rights which vary from one jurisdiction to another. It is also important to note that, where applicable, any implied warranty mandated by law is limited in duration to a period of ninety (90) days from the date of software purchase.
In essence, this Limited Warranty does not cover any claims or issues not specifically addressed in this section of the Agreement.
Limitations on Damages
Scope of Liability
Crafting Table Ltd., along with its licensors, shall not be held liable for any special, incidental, or consequential damages arising from the possession, use, or malfunction of the Game Software. This limitation includes, but is not limited to, damages such as:
- Loss of profits or revenue
- Damage to property
- Loss or corruption of data or files
- Loss of goodwill
- Failures of consoles, computers, or handheld devices
- Errors leading to business interruption or loss of information
- Personal injuries
This exclusion of liability applies even if Crafting Table Ltd. has been informed of the possibility of such damages.
Limitation on Warranty Breaches
In no event shall Crafting Table Ltd. or its licensors be responsible for special, consequential, or incidental damages resulting from any breach of express or implied warranties, or from the violation of any other terms of this Agreement.
Cap on Liability
The total liability of Crafting Table Ltd. for any and all damages, regardless of the nature of the legal claim, shall not exceed the actual price paid for the Game Software. This limitation is in effect even if any proposed remedy fails to fulfill its fundamental purpose.
These limitations are an integral part of the agreement between the user and Crafting Table Ltd. and apply to all aspects of use, possession, and functionality of the Game Software.
Term and Termination
Duration and Termination of License
This License granted by Crafting Table Ltd. remains effective as long as you use, operate, or run the Game. It will automatically terminate if you fail to comply with its terms and conditions. In case of such termination, you are required to uninstall and destroy all copies of the Game Software. You also have the option to terminate the License at any time by uninstalling and destroying the Game Software from your computer(s) or other relevant hardware. Key sections including “Ownership,” “License Conditions and Restrictions,” “Limitations on Damages,” “Term and Termination,” “Indemnity,” “Choice of Law and Jurisdiction,” and “Miscellaneous” will continue to be effective even after the termination of this License.
Indemnity
Obligation to Indemnify
You agree to indemnify, defend, and hold harmless Crafting Table Ltd., its partners, affiliates, contractors, licensors, officers, directors, employees, and agents from any claims, damages, costs, and expenses (including reasonable legal fees) that arise directly or indirectly from your use of the Game Software or any breach of the terms of this Agreement.
Choice of Law and Jurisdiction
Governing Law
This Agreement and the rights and obligations of both you and Crafting Table Ltd. concerning the Game Software will be governed and enforced in accordance with the laws of New Zealand. This applies without regard to conflicts of law principles. Both parties consent to the exclusive jurisdiction of the state and federal courts in New Zealand, for any disputes arising out of this Agreement. Any objection to venue or claims of inconvenience in such courts is waived. If you are located outside New Zealand, the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Amendments
Right to Amend
Crafting Table Ltd. reserves the right to amend this Agreement at its sole discretion. Amendments will be posted on the Crafting Table Ltd. website or communicated through the Steam service. Should any future changes be unacceptable to you, or cause non-compliance with this Agreement, you have the right to terminate the Agreement as outlined above. Installation and use of updates or modifications to the Game Software, or continued use following notice of changes, will signify your acceptance of these changes.
Compliance with Apple Store Terms and Conditions
Acknowledgment of Apple’s Policies
If this Game Software was purchased through the Apple Store, you acknowledge and agree that the use of this Game Software is also subject to the terms and conditions set forth by Apple Inc. for applications distributed through its Apple Store. By purchasing this Game Software through the Apple Store and accepting this Agreement, you are also acknowledging your obligation to comply with the Apple Store Terms of Service, along with any other applicable Apple policies and guidelines.
Additional Restrictions and Requirements
If purchased through Apple Store In using this Game Software, you must not only adhere to the terms of this Agreement but also ensure compliance with all relevant Apple Store policies. This includes, but is not limited to, restrictions on content, user behavior, and data usage as specified by Apple. Any violation of Apple's Terms and Conditions may result in additional consequences as determined by Apple, independent of the terms of this Agreement.
No Conflict with Apple Policies
This Agreement is intended to supplement, and not to conflict with, the Apple Store Terms and Conditions. In the event of any inconsistency or conflict between this Agreement and Apple's Terms and Conditions, the latter shall prevail (In the case where Game Software was purchased through Apple Store).
Miscellaneous
Severability Clause
If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. In such an event, the parties agree that the unenforceable provision shall be replaced with a provision that is valid and enforceable and that most closely matches the intent of the original provision. This Severability Clause ensures that the rest of the Agreement remains intact and enforceable to the fullest extent permitted by law.
Entire Agreement
This Agreement constitutes the complete and exclusive agreement between you and Crafting Table Ltd. regarding the License and use of the Game Software, superseding all prior agreements, representations, warranties, or understandings (except for those made fraudulently). If any provision of this Agreement is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full effect.
